Rosetta Wireless Redux: Tetrodotoxin: Edward Bachner arrested after ordering pufferfish toxin

Tetrodotoxin: Edward Bachner arrested after ordering pufferfish toxin
Chicago Tribune
8:24 AM CDT, July 1, 2008
Federal authorities on Monday charged a Lake in the Hills man with possession of a pufferfish toxin in an amount that one expert said could kill almost 100 people.
Edward F. Bachner IV, 35, who allegedly posed as a doctor when ordering the poison known as tetrodotoxin, was arrested about 10:30 a.m. Monday when he met an undercover federal agent who delivered the toxin to him in Algonquin, officials said.
Bachner recently ordered 98 milligrams of the toxin, which is usually used in research, from a New Jersey chemical supply company, the FBI said. The amount is less than one-one-hundredth of an ounce.
"It's an unusual amount," said FBI Special Agent Robert Holley, head of the Chicago office's counterterrorism Joint Terrorism Task Force. "That's a lot. It doesn't take much to kill."
Authorities said Bachner posed as Dr. Edmond Backer to buy the toxin over the Internet. They would not say what they thought his motive was, but FBI agents said it did not appear to be terrorism-related.
The FBI said in a statement that all of the toxin was recovered and the public was in no danger.
Bachner, who friends said is a financial planner and co-owner of a small technology company in Oakbrook Terrace, was formally charged late Monday afternoon and ordered held without bail during a federal court appearance in Rockford.
But in a highly unusual move, prosecutors did not publicly release the entire criminal complaint filed in the case.
Possessing the toxin, commonly known as TTX, without the proper federal approval is a felony.
Tetrodotoxin-a nerve toxin isolated from pufferfish or made synthetically-is typically used by researchers at universities or pharmaceutical companies.
The chemical is applied to isolate the effects of a particular drug on a cell by eliminating nerve signals that would interfere with scientists' observations, said Robert Zucker, professor of neuroscience at the University of California, Berkeley.
The 98 milligrams allegedly ordered by Bachner would be "about enough to kill 98 people" if injected, Zucker said.
"There's probably no legitimate research purpose for having that much on hand," Zucker said, adding that he has only 1 milligram in his lab.Marine organisms such as pufferfish produce particularly strong poisons that remain lethal when diluted in seawater.
Authorities were alerted to Bachner's alleged purchase of the TTX when an employee at the New Jersey chemical supply company contacted the FBI's Newark office. Agents from that office then contacted Chicago FBI officials, said FBI Special Agent Jane Rhodes, an agency spokeswoman.
Authorities said that when agents determined there was no Dr. Edmond Backer and found out the company Bachner claimed to represent, EB Strategic Research, did not exist, they set up a "controlled buy" in Algonquin.
About a half-hour after Bachner's arrest, agents began searching his two-story, single-family home in the 5700 block of McKenzie Drive in Lake in the Hills, Holley said.
Neighbors in the quiet subdivision watched Monday afternoon as agents wearing biohazard suits carried items outside.
The items, some appearing to be stacks of paper in thick plastic bags, were placed in an inflatable container resembling a child's wading pool and hosed down.
An FBI hazardous materials team was on site, as well as local fire equipment, but Holley said the neighborhood was not in any danger and no evacuations were necessary.
A small portion of McKenzie Drive was blocked, and the area around the home was roped off.
Neighbors who know Bachner and his wife said they were taken aback by his arrest.
Jeff Block, who lives down the block, said Bachner moved into the neighborhood about five years ago.
"He is a great guy. I was extremely shocked when the FBI showed up at my door this morning and started asking questions about him," said Block, who described himself as good friend of Bachner.
If convicted, Bachner could face up to 10 years in prison, according to the FBI.
Tribune reporters Jason Meisner, Timothy DeChant and Liam Ford contributed to this report.

FBI Arrest Man For Possession of Puff Fish Toxin
Posted Jul 1, 2008 by Sue D. in Crime | 16 comments | 583 views
The FBI raided and Illinois man's home on Monday and arrested and charged the man with possession of tetrodotoxin which is a deadly toxin found in puffer fish.
What led to the arrest of the 35 year-old Edward F. Bachner was his attempt to purchase 98 milligrams of the tetrodotoxin, online from a New Jersey chemical company, using an alias of Edmond Backer, claiming he was a doctor working for Illinois-based EB Strategic Research.
EB Strategic Research does not exist.
An employee from the company became concerned at the quantity that Bachner was trying to obtain and alerted the FBI.
A member of the FBI joint-terrorism task force delivered the toxin to Bachner's home on the 5700 block of McKenzie Drive in 'Lake in the Hills', and after accepting his purchase, he was arrested.
Edward F. Bachner, 35, of Lake in the Hills, was charged with one count of illegal possession of a toxin, according to a federal complaint filed in U.S. district court. Bachner is listed as the corporate secretary of Rosetta Wireless Corporation in Naperville, in suburban Chicago.
Tetrodotoxin is a neurotoxin that in large doses can cause paralysis and death and according to reports it is 1,200 times more deadly than cyanide.
No reports as to what Bachner was planning on doing with the toxin and he appeared before a judge in federal court in Rockford and is being held without bond until his next court appearance.

William Blair & Company and CIMA Release Fifth Installment of Semiannual Interactive Marketing Survey
CHICAGO--(July 8, 2008)--William Blair & Company, in collaboration with the Chicago Interactive Marketing Association (CIMA), today published the fifth edition of a semiannual interactive marketing survey that the partnership uses to take the pulse of the industry and relay its practitioners' expectations for future performance and trends.
The survey targets the more than 800 members of CIMA, which was founded in 1997 and emphasizes cross-media outreach through an extensive itinerary of forums, panels, and seminars with industry experts, in addition to networking events. The fifth survey includes responses from nearly 150 members.
The fifth survey was conducted during second quarter 2008 and included 27 multiple-choice questions and two open-ended questions, of which 10 have been constant in all five surveys. All responses are anonymous.
William Blair equity research analyst Troy Mastin, who provides coverage on 21 marketing, advertising, and media companies, wrote in the survey, "Survey respondents indicated that the state of the industry remains healthy, but slightly less robust than previous surveys, most likely due to the shaky economy. The industry is expected to grow 16.1% over the next 12 months, which is below a consistent level of about 19% in the first four surveys, and online media prices have risen just 3.2% over the past six months versus an average of 7.2% in past surveys. Respondents expect search and direct marketers to be less affected (or possibly benefit) from the perceived slowdown in the industry."
Mastin also noted that Google remains dominant and Yahoo continues to slip. "Google was considered the best-positioned Internet 'media' company for the next two years, garnering 61% of the responses, up from the previous two surveys," he wrote. "Facebook, a stand-alone option for the first time, was a distant second with 11% of the responses, surprisingly exceeding much larger players like Yahoo, which received only 7% of responses (down from 30% in our inaugural survey published in early 2006). We expect the social networks and emerging players will continue to gain share from the portals, due to changes in consumer preference and the increasing fragmentation of the landscape."
Mastin concluded: "We remain bullish on the industry and continue to view it as an attractive one in which to invest. Companies with a strong connection to consumers, agencies, and technology-enhanced service providers are best positioned to capitalize on this growth. In the near term, we expect that shares of Google will lead the group because of its continued dominance in search and recent moves to secure strong positioning in display, video, social networking, and mobile advertising. Fundamentals remain strong for comScore, Omnicom, Interpublic, MDC Partners, and Web.com as well."
About CIMA: The Chicago Interactive Marketing Association's mission is to provide a forum for all professionals involved in interactive marketing to share ideas, continue their professional development, identify best practices, meet and stay connected to industry colleagues, and promote the value and successes of interactive marketing. Visit www.ChicagoIMA.org to learn more about CIMA.

Hey Ron, great meeting you at the Freeborn and Peters event the other
day. I am a musician-entrepreneur, and I dig your style. Any chance I
might be able to get a plug in your May Report to see if anyone wants
to venture into the music biz and put 20k into publicity of an
upcoming Jazz potential-hit album? It's already recorded and printed,
I can send you some copies if you'd like. That's the latest venture
I've gone into, and I haven't put out any plugs for it yet.
Thanks,
Greg

Briefly noted, by Ron May
* Stel V. from OnShore told me that he expects to hit $6.75MM in revenue this year, but he does not think he can make it to $7MM. Stel told me that the staff size has grown from 49 to 51 from a year ago.
* Apparently, the law firm of Schwartz Cooper lost its entire IP department to another law firm. I googled it. Six lawyers in IP at Schwartz just left for Ungaretti and earlier a whopping 53 lawyers left Schwartz for Dykema Gossett. Schwartz Cooper had 64 lawyers and the mass move to Dykema was more of a merger, informally, than a raid. But the Ungaretti Harris move was specifically the IP department.

* I meant to mention about a month or more ago that federal judge Leinenweber ruled entirely in favor of Denis Kappel in her case against Advanced Equities, on all the fees and fines that FINRA decided on. Every nickel is going to Denise and her lawyers.
* Signature Days update. It appears that I may have had some skewed information about Signature Days. Andrew Playford, Founder and Chief Executive Officer, Signature Days, went personally bankrupt trying to save the firm, I have been told. Chris Widdes, Vice President of Business Development for Signature Days, made some bad deals with outlets for their cards, prime among them WalMart. They put $800K into gift cards for WalMart and you have to pay that to WalMart up front. Almost all the sales are tied to December for the X-Mas season.
* I guess that Gary Slack has no one minding the store -- as in the website.
Steve Johnson who has left SBP is still featured in a number of spots on the site. So is Don Barshinger still on the site:

* I have 55 minutes until it hits 5pm. It is 4:05 Friday afternoon. I can talk about the ITA down by the river party on Wednesday and the SPS3 event Thursday night at Mullen's in Lisle. One of the top stories I got from those events was the tip-off on what happened to Ed Bachner IV, the son of Ed Bachner III. Ed, as you recall, was one of the founders of Rosetta Wireless. At one time a few years back, Rosetta was considered widely to be an up-and-comer in Chicago high tech. Rosetta got $2MM from the ATP program administered by NIST. Many of us have known the Bachners for years. Ed Sr. was with Motorola for years and he was a regular at the MMM and the MEF, among other places. I saw him present a number of times.
Jack Curley mentioned it to me Thursday night at SPS3 and he thought I already knew about it. Jack said that the ITDA or Battelle incubated Rosetta for a year and a half or so. I attended their launch party in Oak Brook Terrace years ago. If you type Rosetta into the TMR archives, 73 items come up.
http://www.tmronline.com/A55951/tmrarticles.nsf/39918186ac76b68a8625692400787eb1!SearchView
I have had some pretty spirited discussions with several people on whether anything about this story should appear in TMR. How is it relevant to what is going on in Chicago high tech?
Well, it is not technically tech news, but this is one story I will bet people will want to know about. One person said it has no relevance and another said I should just put in a link and one or two lines and leave it at that.
Another person tipped me off to the double indemnity side of the story.
Even Channel 5 is investigating and a report by Charlie Wojciechowski mentions Ed Bachner III and also Keith Campbell and the ATP grant.
http://www.nbc5.com/morning/16814459/detail.html
+++++++++++++++++++++++++++++++++
"NBC5's Charlie Wojciechowski reported that agents said in court that they found in Bachner's home 50 knives, a 9mm Glock handgun and fake CIA credentials. The search also turned up books on how to make silencers for firearms; castor beans, which can be used to make the poison Ricin; and a $5 million insurance policy taken out on Bachner's wife without her knowledge.
But Assistant U.S. Attorney Mark Karner told the judge that 25 one milligram vials containing the toxin were recovered from the trunk of Bachner's car. Twenty empty vials with toxin residue were found elsewhere in the vehicle, he said.
That left 19 of the 64 vials prosecutors believe Bachner had at one time still unaccounted for, Karner said."
+++++++++++++++++++++++++++++++++
OK, are you confused? Why would a guy who wants to kill his wife buy so much more poison than necessary?
Think Tylenol. Think terrorism. Think the double indemnity clause in his insurance policy on his wife, Rebecca Bachner, and that clause was a rider.
If Ed could kill his wife with poison and at the same time make it appear to be tied to some crackpot or terrorist plot which could easily explain the empty vials, then the whole thing starts to make sense.
Then the insurance pays double and Ed gets $10MM. If Ed could make it appear that some kind of terroist plot was behind the plot to kill his wife (and his alleged plot has not been proved yet), by planting those viles in stores, let's say, then he could collect double on the insurance.
Eric Zorn discusses this in his column dated July 8, 2008 entitled "Big policies for insurance benefit none"
+++++++++++++++++++++++++++
http://www.chicagotribune.com/news/local/chicago/chi-zorn071008jul10,0,3169982.column
My questions to Weisbart assumed a level of rationality in the life-insurance game that doesn't exist. Take, for example, the reported "terrorism rider" on Rebecca Bachner's life-insurance policy that added an extra benefit if she were to die as a result of a terrorist act.
Weisbart said such riders, though rare, are simply variations of traditional coverage that doubles the payment to survivors in cases of accidental death.
"You can argue that the shock that follows an unexpected or horrifying death might require all sort of therapy for the survivors," Weisbart said. "Other than that, I can't think of any reason why one particular kind of death should be insured differently from any other.
"For the most part we're talking about a product that's sold on an emotional basis rather than on a financial basis. It's almost a lottery ticket in some ways."

I haven't been following local news as much as I should, but this is certainly a doozey.
* I just saw an ad on MS/NBC (Hardball) at 4:56pm for www.getfave.com. Jon and Jeff appear to be doing well.
* Turnout at both events, the ITA and SPS3 was pretty good. The best estimate I heard for the ITA was around or about 100-120.
Three to four hundred at SPS3. I did not count. But it was a good crowd and the ribs were good! Meat fell right off the bone. I hear food and drink ran out fast at the ITA. At SPS3, food and drink lasted all night.
Thanks to Bob Brill for the ride home. He took me and Daliah Saper.
On that subject, there were a number of folks from the city at the SPS3 party. I figure at least 25 people from the city: Tom Sherman, Daliah Saper, Robert Jacobi, John Dallas, Erika Blackwell, Eric Wettstein, Jim Figliulo, Todd Allen, Sachin Agarwal, Jim Peters, and a few folks from M5 which also had a display.
The mystery woman from the TC8 party, "Ara Berberian," who has some connection to www.hoodfind.com was there. She came up to me and ran off when I realized who she was. Look, she is a hottie which is why I am so interested in finding out who she is.
One person who has not been seen in ages is David Naylor. He showed up at the ITA but not SPS3. David, you have also gained a lot of weight. What's up, man? Significant and rapid weight gain usually means things are not going well.
Bob Biddle who used to work at MediaRiver was at the SPS3 party and he is back from Arizona where he worked for a start-up. Now he is with CompTIA as VP of eBusiness and Software Solutions.
Jim Eiden says that he was approached by a state official about his switchgrass idea which he presented at the MIT-EF White Board Challenge.
Hazel Wagner gave me a copy of a book in which she has a chapter, entitled "Speaking of Success." Hazel ssid that she was paid a dividend from Eolas on their settlement with Microsoft. She has tried valliantly but without success to find out how much Eolas got in the lawsuit settlement. But she still owns the stock and they have not paid out on the stock yet, just the dividend. Hazel would not say what the dividend was but she did tell me that it was enough to pay for a trip to Europe, which she did not take. Hazel soes something similar to Gerald Haman with her consulting biz www.b9d.com.
Richard Godwin whom I met at an ITDA MMM before he started his firm has started with www.localimpressions.net and he is launching in Naperville where he sells advertising for $49/mo. The customer gets one 15 second animated advertisement that shows up every six minutes on a screen in a bar or restaurant. He has ads running on three screens now and has a few dozen customers thus far. As I said, just starting out, and he lives in Naperville, so it is easier to sell and control, he told me.
Much, much more. And the story of Charles Wu ( www.cticonnect.com) and the people I met at Viagra triangle on Wednesday night.
Fritz Golman is now working with NAVTEQ on their TV programs through www.traffic.com which is a firm they purchased. He and Tom Johnson were at the ITA.

* Most of you are by now aware that I have been talking to a lot of people and preparing for a presentation for how to make TMR more of a business and less of a hobby. That presentation will take place on July 21st.
Two ideas popped into my head, quite by accident, and how they have formed the basis for a business model. Well, that is not quite accurate. At some level, I have been mulling this idea for a long time. It even goes back years to when Connolly proposed the idea of keeping kosher or separating the clean and dirty laundry, the gossip or what people call gossip and everything else. Really, the best line in the Ron May facts site below is "The smaller the issue, the bigger the story." Ain't it the truth!
When I collected all those cards at the LES and the biofuels conference held here in last April and early May, I had the idea at that time that I could somehow use that list of people, even though very few of them were from Chicago. In fact, they were from all over the world. But it was not a real business idea at the time. Then the idea popped into my head at 4am on June 15th when I actually created a separate list for those people and we were preparing for Jeff Meredith's coverage of BIO 2008. I figured that this could be a separate "neighborhood," so to speak, for TMR.
The idea was that the list is worth more split up than together and it works both ways. Specialty coverage can be something like bio/nanotech but it can go to people outside of Chicago and advertisers could be IP law firms that would spend real money for it. They would get a much broader exposure than just Chicago.
The other way to expand is horizontally, staying within Chicago but broadening coverage beyond technology. Argo Tea, for example, and many others, are good stories of entrepreneurship.
Another example of a channel is Motorola. Many Motorolans and ex-Motorolans are on the TMR list. But several people have told me that they don't care what goes on within the four walls of Motorola. One of those people was Matt McCall; another was Dennis Serio and today, that was echoed by Raman Chadha.
Raman has little interest in the internal scheming and layoffs, but he does very much want to know about businesses being started by engineers who have left Motorola.
So, one specialty report or channel could be Motorolans because there is still great interest in the firm, even if it is limited somewhat to those directly effected by what goes on there.
The Motorolans themselves who read the report could be the basis for the more positive stories about new start-ups that have come out of the firm.
Speaking of Motorola, that letter I published earlier this week about how a Motorola woman was really screwed over on her VSP reprsents a big problem for the honor and integrity of the way the management operates at the firm. I am looking into it and will have more for you.
So, five "neighborhoods" right off the bat could be:
1. Bio/nanotech and IP
2. Political and tech, government/education and tech.
3. Motorola
4. Chicago tech start-ups
5. Entrepreneurship stories in general for Chicago
I don't see the day when I stop being myself and one big issue is how much of this report is Ron May. I think we can separate the clean and the dirty laundry and maybe even have a pure gossip report for all the people who don't like the scraps or the crap. I fall into the camp of those people who believe that this report is not a cult of personality. I will prove my point now.
There are many who know me personally or have heard about me, but there are also many who just know TMR as an internet email newsletter they get in their mailbox.

Of all these people, the only one I would recognize on sight is Michael Rosenthal. So, in some firms, less than 10% of the subscribers even know me. Maybe 25% have met me at one time or another. But when less than 25% have had the "benefit" of a "Ron May encounter" we should be careful about overstating the importance of my personality and method of operation.

How many of these folks have I even ever met? I don't know, but the only one I know I know is Lloyd Shefsky.
I just picked a few tech firms and similar percentages apply. But I decided not to print those lists so I don't get the denizens into trouble if a story about that firm should come up.
Yes, TMR does not equal Ron May by a long shot. And that reality is a necessary condition if the report is to grow beyond its current state. I have often wondered who could do this job if I were to die tomorrow, but I could not come up with any one person who can combine all things. I am sure a lot of founders feel that way. We would probably have to split up my job into a number of parts.
That's a good question to ask the readers in a survey I will do on Monday or Tuesday, thanks to Andrew Taylor allowing me to use his SurveyMonkey account. It is the community and I am in the role of Tom Sawyer many times. To get one of those write-ups, many behind the scenes calls and emails often have to be made.
TMR is a lot of Tom Sawyer too. As I pointed out to Lanny Feder last night, his time to chip in has come. I will be on his case for a write-up of some event, just as I was with Daliah Saper and she did a good job as Avery Cohen has done with the MIT-EF and other events.
Without the letters and the write-ups from others, TMR would be thin indeed -- at least much of the time.
Now, in talking to Raman Chadha, I will start calling those neighborhoods channels instead. That is the more professional business terminology.
The next "channel" idea came to me on the 4th of July weekend when for some reason I googled Nik Rokop and for the life of me I can't recall why I googled him. Lee Neubecker, could you reconstruct what I did on the computer which might jog my memory?
The fourth or fifth thing to come up when you google Nik Rokop is The Huffington Post website which lists all political contributions for anyone in the country for the last few years.
Once I saw that, it was off to the races. For a long time now, I have had the idea of reporting on the interface between technology people and politics. But it had not crystallized in my mind until I saw the Huffington Post site.
I am not saying that I am going to have the time myself to do all of this reporting. But I could manage it and we could get some Medill students and other interns to help out.
And I am not looking to get into a political opinion site. This would be more informational and data-centric. What is going on in various states, what tech policies are in place, things like federal funding tracking, where the money goes from various agencies, what educational institutiions are doing, etc., etc., etc.
And with the Huffington Post info. who gives to whom and why. Mik Rokop and Sean Murdock gave to a candidate for Congress who is from Indiana, Visclosky. I am sure the contributions were tied to his involvement in tech policy.
To use Raman's terminology, this may not be the best channel to pursue, but I could see TMR becoming five or six channels in different interest areas.
I have many more names to add, like Blair Hull and Jim Tyree from Mesirow who has made more contributions politically than you can shake a stick at.
Here are some of the people I have looked at include and believe me, there is much more:
http://fundrace.huffingtonpost.com/neighbors.php?type=name&lname=
Contributions by zip code:
All of City of Chicago: $20,896,058 was given by people who identified their city as "chicago".
$4,337,954 from 2,468 people to Republicans
$16,558,104 from 11,837 people to Democrats

60611 $2,064,740
60564 $171,645
60062 $528,233
I am in the process of going through all Chicagoans who contribued, whether in tech or not. There are some gems contained therein. .
This first group is famous or well-known Chicagoans.
